1. About these terms

These Terms of Use ("Terms") govern your access to and use of Manavizha Invitations at invitation.manavizha.com, including the editor, templates, music library, RSVP, maps, sharing and export features (together, the "Service"). The Service is operated by Akmo Solutions Private Limited, No. 14, SKCL Techsquare, SIDCO T.V.K Industrial Estate, Guindy Industrial Estate, Guindy, Chennai, Tamil Nadu 600032 (GSTIN 33ABDCA4126G1Z5) ("we", "us", "our").

By creating an account, buying a plan or using the Service, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Service. These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature.

Manavizha Invitations is separate from the Manavizha matrimony service at manavizha.com. An account on one does not create an account on the other, and each has its own terms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Indian law to create an account or make a purchase. Guests who only view an invitation or submit an RSVP do not need an account, but must still use the Service lawfully.

3. Your account

• Give accurate information and keep it up to date.
• Keep your sign-in details confidential. You are responsible for activity under your account.
• Tell us promptly at support@manavizha.com if you suspect unauthorised use.
• One person may not hold multiple free accounts to get around plan limits.

4. Plans, validity and payment

• Paid plans apply to a single invitation and are not subscriptions. There are no automatic renewals.
• Prices are in Indian Rupees and include applicable GST. A tax invoice is issued for every purchase.
• Payments are processed by Cashfree Payments through UPI, cards, net banking and other methods they support. Their terms also apply to the payment.
• When a plan's validity ends, the invitation, its photos, album, music and RSVPs are automatically and permanently deleted (we email you a few days before). Invoice and payment records are kept as required by law. See our Privacy Policy for details.
• We may change prices or features for future purchases. Changes will not affect plans you have already paid for during their validity.
• Refunds, cancellations and upgrades are covered by our Refund & Cancellation Policy.

5. Your content

5.1 You own your content

"Your Content" means the text, names, photographs, audio, video, addresses and other material you add to the Service. You keep ownership of Your Content.

5.2 Licence you give us

You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, process, adapt (for example, resize or compress), display and transmit Your Content only as needed to operate the Service: to show your invitation to people with the link, generate exports, deliver RSVPs and provide support. This licence ends when Your Content is deleted from our systems, except for copies in routine backups that are overwritten in due course. We will not use your photographs or personal content in our marketing without your separate permission.

5.3 Your promises about content

By adding content, you confirm that:

• You own it or have all rights, licences and permissions needed to use it in the Service.
• You have the consent of each person whose name, photograph, address or other personal details appear in your invitation, or are otherwise lawfully entitled to share them.
• It does not break any law or infringe anyone's rights, including copyright, trademark, privacy or personality rights.

5.4 Uploaded music and audio

Most commercial film songs and albums are protected by copyright, and owning a copy of a song does not give you the right to publish it online. Do not upload music unless you own it or hold a licence that allows you to use it in a publicly accessible web page. By uploading audio, you warrant that you have those rights, and you agree to indemnify us against claims arising from your upload. We may mute, remove or replace uploaded audio, without notice or refund, if we receive a complaint from a rights holder or believe it infringes copyright. If in doubt, use our built-in music library, which is licensed for this purpose.

6. Our templates, music and content

The Service, including its templates, designs, illustrations, fonts we provide, the built-in music library (composed and produced for Manavizha), wording library, translations and software, belongs to us or our licensors and is protected by intellectual property laws.

We give you a limited, non-exclusive, non-transferable, revocable licence to use these materials only to create, share, print and display your own invitations through the Service. You may print your exported invitations for personal or family use. You may not:

• Extract, download, rip or redistribute built-in music tracks separately from your invitation.
• Resell, sublicense or offer our templates or designs as your own product or service.
• Use our templates or music in other platforms, commercial advertising, films or videos.
• Remove Manavizha branding from Free invitations by technical means.

Printed-card wording from our library may be copied into your own invitations, whether digital or printed.

7. Prohibited uses

You agree not to use the Service to create, upload or share anything that:

• Is unlawful, defamatory, obscene, pornographic, invasive of privacy, or hateful towards any religion, caste, community, gender or group.
• Harasses, threatens, impersonates or misleads anyone, including fake invitations designed to deceive.
• Promotes child marriage, dowry, or any practice prohibited by Indian law.
• Involves fraud, phishing, spam, pyramid schemes, gambling or collecting money under false pretences.
• Contains malware, or attempts to probe, scrape, overload or gain unauthorised access to the Service.
• Harms minors in any way, or threatens the unity, integrity, security or sovereignty of India.
• Otherwise violates the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 or any other applicable law.

You also agree not to use automated tools to create accounts or invitations in bulk, or to resell the Service without our written agreement.

8. Takedown, complaints and grievances

If you believe that an invitation infringes your copyright or other rights, or contains your personal information without consent, or is otherwise unlawful, email support@manavizha.com with the invitation link, a description of the issue, proof of your rights where relevant and your contact details.

Our Grievance Officer will acknowledge your complaint within 24 hours and act on it within 15 days, or sooner where the law requires (including within 24 hours for certain complaints about intimate or impersonating content). We may remove or disable content, suspend the invitation, or ask the creator to make changes. Where appropriate, we will tell the creator and give them a chance to respond.

9. Third-party services and disclaimers

• Maps: venue maps and directions are provided through Google Maps. We do not guarantee their accuracy. Please check the address and location pin before sharing, and advise guests to confirm directions.
• Sharing: WhatsApp and other apps used to share invitations are run by third parties. We are not responsible for their availability or policies.
• Payments: Cashfree Payments and your bank process transactions. We are not responsible for delays or failures within their systems, though we will help you resolve them.
• Translations and wording: we take care with our 22 Indian languages and English, but customs differ between families and regions. Please review your final wording, names, dates, times and spellings before sharing or printing.
• Print: colours and sizes of printed exports may differ from what you see on screen.

The Service is provided on an "as is" and "as available" basis. While we work hard to keep it reliable, we do not promise that it will be uninterrupted, error-free or available at any particular moment, including on the day of your event. We recommend keeping a downloaded copy of important invitations.

10. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special or consequential losses, including missed events, guests who did not attend, loss of goodwill, or loss of data, arising from your use of the Service.
• Our total liability for any claim relating to the Service is limited to the amount you paid us for the invitation the claim relates to, or ₹1,000 if you have not paid us anything.
• Nothing in these Terms limits any liability that cannot be limited under Indian law, including your rights under the Consumer Protection Act, 2019.

11. Indemnity

You agree to indemnify Akmo Solutions Private Limited, its directors and staff against any claims, losses and costs (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or third-party right.

12. Suspension and termination

You may stop using the Service and delete your account at any time from your dashboard. We may suspend or terminate your account or any invitation, with or without notice, if you breach these Terms, if required by law, or to protect guests, other users or the Service. Invitations removed for violating these Terms are not eligible for a refund. Sections that by their nature should continue (including 5.4, 6, 10, 11 and 14) survive termination.

13. Changes to the Service and these Terms

We may improve, change or discontinue features from time to time. If we discontinue the Service entirely, we will give reasonable notice and a pro-rata refund for unused validity on paid plans. We may update these Terms; we will notify you of significant changes by email or in the app. Continued use after changes take effect means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any concern amicably. Subject to that, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, without affecting any right you may have under the Consumer Protection Act, 2019 to approach a consumer commission.
